Article 1. Applicability.

1.1 These terms and conditions (hereinafter referred to as the: ”conditions”) apply to all orders placed with and agreements entered into with Frederik Roijé Collection.

1.2 Accepting an offer or placing an order shall mean that you accept these conditions.

Article 2. Prices and payment.

2.1 Unless otherwise stated or agreed in writing, the prices of the products and services offered are quoted in euros, inclusive of VAT, but exclusive of shipping costs, taxes, and any other charges.

2.2 Products will be delivered upon receipt of payment, unless otherwise agreed.

2.3 Payment must be made in advance.

2.4 If the prices of the products and services increase between the date of the order and the date of fulfilment, such price increases will not be passed on to the customer, except for price changes resulting from changes in VAT rates or other taxes or levies.

Article 3. Delivery and shipping.

3.1 The delivery dates specified by Frederik Roijé Collection are indicative only. In the event of a delay in delivery, you shall not be entitled to any compensation, to cancel the order, or to terminate the agreement.

Article 4. Intellectual and industrial property right.

4.1 You must fully and unconditionally respect all intellectual property rights and industrial property rights pertaining to the products supplied by Frederik Roijé Collection.

Article 5. Complaints and liability.

5.1 If, for any reason, you do not wish to keep a product, you have the right to return it to Frederik Roijé Collection within 14 days of receipt. Returns will only be accepted if the product is received by Frederik Roijé Collection in its original packaging, in new condition, and undamaged. The costs of returning the product shall be borne by you.

5.2 Returns sent with insufficient postage will not be accepted.

5.3 In the event of a defective product or if you have received an incorrect item, Frederik Roijé Collection will cover the return shipping costs.

5.4 Returns accepted by Frederik Roijé Collection will be replaced with a replacement product as soon as possible, or the original invoice amount will be refunded. Refunds will be issued within 30 days of receipt of the returned product.

5.5 Frederik Roijé Collection accepts no liability whatsoever for any claims for damages or consequential damages, on any grounds whatsoever, arising from the use of its products by consumers or third parties.

Article 6. Orders.

6.1 Frederik Roijé Collection shall not be liable for any misunderstandings, distortions, delays, or failure to properly transmit orders and communications resulting from the use of the internet or any other means of communication between you and Frederik Roijé Collection, unless such circumstances are attributable to wilful misconduct or gross negligence on the part of Frederik Roijé Collection.

Article 7. Applicable law and jurisdiction.

7.1 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions themselves, shall be governed solely by Dutch law.

7.2 All disputes between the parties shall be submitted exclusively to the competent courts of the Netherlands.
